Barcelona and 9 de Octubre could be sanctioned for clauses in players’ contracts

On October 9, the arrival of Carlos Garcés and Gabriel Cortez is formalized as new reinforcements of the club of the Sporting Club Barcelona. Both were officially announced by the Guayaquil team and the details were disclosed in their contracts with the ‘Super 9’. Could there be a sanction for the clubs?

One of the novelties that has come to light is what was announced by Alfaro Moreno, president of the Barcelona Sporting Club, in front of the Gol TV cameras: “In the contract clause of Garcés and Cortez, it is stipulated that they cannot play against Barcelona.”

It was a novelty, since the striker Carlos Garcés mentioned that he was unaware of said clause: “I really don’t know, I found out about it recently on social media,” the 32-year-old striker said after his first game in the Oct. 9 shirt.

However, Andrés Holguín, lawyer who spoke in Sports Area, explained this event which would be punishable by Pro League: “These clauses (Cortéz and Garcés) were fashionable in the 90s. People started abusing these types of clauses and FIFA implemented these two regulations: TPO, and TPI. In the TPI it is forbidden to say that a player is playing against his former team,” said Holguín.

“La LigaPro could open investigations in order to sanction the teams. La Liga Pro could sanction the clubs since FIFA is preventing what was done with Cortez and Garcés,” he added, referring to the fact that FIFA has clear regulations in this regard.
