A teenager was abused in a store after leaving football training

A 13-year-old boy was abused in a store after leaving football practice. The rapist must serve twenty-nine years and four months in prison. In addition, he will have to pay a fine of thirty-two base salaries ($13,600) and full compensation of $3,000 in favor of the victim.


The State Attorney General’s Office specifies that they were recorded on February 8, 2019, in the Cuba district, Pomasqui sector, north of Quito. The victim left football practice and went to a store to buy a chocolate. At the scene, he met Daniel Gonzalo BB, to whom the teenager owed $3 for a phone top-up.

The now convicted man told him that “he had to pay it”, so – taking advantage of the young man’s vulnerability – he ushered him into the store and sexually raped him.

A few days after the event, the teenager told what had happened to his parents, who filed a complaint with the prosecution.

Prosecutor Maribel Vargas, from the Comprehensive Care Unit (SAI), demonstrated the commission of the crime with convincing evidence:

  • The testimony expected from the victim.
  • The testimonies of the parents, the medical examiner and the clinical psychologist.
  • To these were added reports on the social environment and reconnaissance of the scene of events.


Daniel Gonzalo BB was sentenced for the crime of rape, characterized and punished in article 171, number 3, of the Global Organic Penal Code (COIP).

In this case, the aggravating circumstances provided for in article 48, number 9, of the same judicial authority (knowing the victim before the commission of the offence) were added, which increased the sentence pronounced by one third.
